Employee Free Choice Act Passes House

The U.S. House of Representatives passed the so-called “Employee Free Choice Act” (H.R. 800) on Thursday, March 1, by a 241-185 vote.

The Employee Free Choice Act requires employers to recognize a union if the union presents signed authorization cards (“card checks”) from a majority of employees, depriving employees the opportunity to cast a secret ballot when making this important decision. The legislation now goes to the Senate for consideration.

“Though expected, it is very disappointing to learn that many members of the House of Representatives agree that workers do not have the right to a secret ballot election to determine whether they wish to be represented by a union,” said ALFA President & CEO Richard P. Grimes. “ALFA, in collaboration with our coalition partners, will not only vigorously fight this legislation in the Senate but will also continue our advocacy efforts in the House to ensure that we are able to sustain a presidential veto if necessary.”

ALFA will mobilize grassroots efforts to oppose this legislation in the Senate. Participation and support from ALFA members, assisted living providers, and all concerned with this threat to employees’ right to choose representation without coercion in senior living communities will be critical in the next phase of ALFA advocacy efforts. ALFA, the U.S. Chamber of Commerce, and other leading national trade and business organizations have formed the Coalition for a Democratic Workplace to oppose the Employee Free Choice Act.
