ALFA Action Alert: Tell Congress to Act Against Anti-Employee Initiatives, Union Provoked Initiatives.

Labor unions are trying to achieve through regulation some of the advantages they sought unsuccessfully in the Employee Free Choice Act (EFCA).  They have shifted their attention and activities from the halls of Congress to the halls of more sympathetic government officials at the National Labor Relations Board (NLRB) and U.S. Department of Labor (DOL).

The National Labor Relations Board (NLRB) and Department of Labor (DOL) have proposed new rules, which are opposed by ALFA, because they deprive employees of information and ultimately an informed choice when deciding if they wish to be represented by a union. Jackson Lewis LLP serves as ALFA’s labor counsel and has prepared a summary of these issues in “NLRB Proposes “Ambush/Quickie Union Election” Rules”.

ALFA is pleased to provide you with an easy way to contact your members of Congress to tell them to stop the NLRB’s pursuit of “ambush elections” and “micro-unions” by rule.

Combined, these proposed rules would:

  • Dramatically decrease the time employers have to speak with their employees about union representation, potentially shortening the entire election process to as little as 10 days from the current median of 38 days;
  • Effectively block businesses from obtaining legal and other advice about how to talk to employees during a union organizing drive;
  • Allow unions to organize certain groups of employees in a workplace.  An example of this would be organizing just the dining staff in a senior living community or having several unions organize different workers in a senior living community, such as one union representing dining staff and another representing care staff and so forth. 
  • Ensure many attorneys will be unwilling to assist employers under new rules that could force both client and counsel to disclose vast amounts of private financial and other data;
  • Unfairly tip the scale toward union organizers and leave employees without enough information or time to make a real decision in a real election.

Please take a brief moment to voice your opinion and tell members of Congress to stop regulators from pushing the unions’ agenda for “ambush elections” and other changes that would deprive employees of the information they need to make an informed choice about union representation. 

Only a forceful reply from employers and employees can convince Congress to stop the NRLB and DOL and to oppose these costly, bureaucratic, and unfair rules so that we can return to focusing on our residents and senior living communities.
