Argentum submitted comments today in response to a request for information by the White House Office of Management and Budget (OMB). The RFI asked about regulations that should be rescinded or replaced that are unnecessary, unlawful, unduly burdensome, or unsound, and specifically related to regulations that are inconsistent with statutory text or the Constitution, where costs exceed benefits, where the regulation is outdated or unnecessary, or where regulation is burdening American businesses in unforeseen ways.
Our comments underscored the challenges that face long-term care and how assisted living is an essential solution to those challenges, and the state regulatory model is fundamental to supporting our communities. We specifically requested the administration to review these regulations:
Home and Community-Based Services (HCBS) rule, finalized by CMS in January 2014;
Ensuring Access to Medicaid Services, finalized by CMS in April 2024;
Minimum Staffing Standards (nursing home) rule, finalized by CMS in April 2024; and
Overtime rule, finalized by Department of Labor in April 2024.
We also requested that the administration review regulations with overlapping federal, state, and local requirements, specifically related to reporting where additional federal reporting does not result in improved resident care. Our comments will be used by OMB to influence future rulemaking by the administration, with each agency considering feedback submitted by stakeholders as part of this process.
