On April 23, DOL issued its joint employer proposed rule. The 2026 rule differs from the first Trump administration’s 2020 rule to account for litigation that resulted in the 2020 Rule’s vertical joint employer liability standard being vacated. Because of the complex nature of the litigation, The Coalition for a Democratic Workplace (CDW), of which Argentum is a member, has engaged a prominent law firm to draft comments to the rule. Argentum will join many businesses and organizations signing-on in support of the comments CDW submits to DOL regarding the proposed Joint Employer Rule.
