Rulemaking Begins on ROAD to Housing Act, Argentum Plans Comments to Protect Senior Living

[current_event_date]

The U.S. Department of the Treasury released a proposed rule to begin implementing portions of the 21st Century ROAD to Housing Act, which became law in July without presidential action. Treasury is specifically seeking comments related to Section 1001, which restricts certain purchases of single-family homes by large institutional investors and establishes several statutory exceptions.

Argentum has been actively engaged on this issue since the legislation was first considered by Congress, raising concerns that the law’s exceptions for new construction, renovations, and rental conversions do not clearly address homes located within existing senior living communities. Without additional clarification, those provisions could create uncertainty for senior housing transactions that are unrelated to the housing market concerns the legislation seeks to address.

As part of those advocacy efforts, Argentum worked with House Financial Services Committee Chairman French Hill (R-AR) to secure clarifying language in the Congressional Record to reinforce congressional intent that senior living communities were not the target of the legislation. The language states that:

“purchases of homes used to provide residential care for individuals with disabilities or developmental disabilities, or in senior living communities, should be exempt, as these are unrelated to the problem being addressed by the Act.”

Argentum is currently reviewing Treasury’s proposed rule to determine whether it adequately reflects that intent and sufficiently protects senior living providers from unintended consequences. We will submit formal comments on behalf of the industry during the public comment period, which closes on November 23, 2026. Members are encouraged to share any concerns, operational impacts, or examples that may help inform Argentum’s comments. Feedback can be submitted to Argentum’s Policy and Advocacy team and will help strengthen the industry’s response as Treasury considers the final rule.
