On Friday, The U.S. Citizenship and Immigration Services (USCIS) issued updated guidance extending employment authorization for Haitian Temporary Protected Status (TPS) beneficiaries through July 24, 2026, pursuant to a court order in Miot et al. v. Trump et al.. This applies to individuals with EADs bearing category codes A12 or C19 that were previously set to expire on July 10.
The extension follows the U.S. Supreme Court’s June 25 decision in Mullin v. Doe, which allows the Administration to proceed with terminating TPS protections for Haiti, Syria, and other affected countries. Current USCIS guidance provides the following TPS employment authorization end dates:
- Haiti: July 24, 2026
- Syria: July 17, 2026
- Burma/Myanmar, Yemen, Ethiopia, Somalia, and South Sudan: July 17, 2026
SAVE Verification
USCIS has confirmed that SAVE will continue to verify TPS status using TPS-related documents, including Form I-797 Approval Notices and Form I-797C Notices of Action. SAVE responses may indicate:
- “Temporary Protected Status – Employment Authorized – Temp Emp Auth”
- Employment authorized through July 24, 2026 (Haiti) or July 17, 2026 (Syria and other affected countries)
- DHS comment directing employers to monitor USCIS TPS webpages for updates.
